The Verdict is In: Kimkins Diet Scam Lawsuit

The wheels of justice turn slowly, but turn they do.

Three years ago, I was asked to review a diet called "Kimkins" which was making a lot of headlines. Slowly, my writing on the subject changed from a review of an unhealthy diet to a report on a diet scam, with all kinds of tabloidesque details - stolen photos, bizarre lies, people with health problems caused by the diet, and outright fraud. There was a class action lawsuit brought against the developer of this diet and Web site, Heidi Diaz. Well, finally the judge has issued a verdict, including:
  • The people participating in the lawsuit were awarded $1.8 million in restitution and another half million dollars in punitive damages, plus attorney's fees.
  • Ms. Diaz is to post information on all her Web sites about some of the lies that she has perpetrated in the past.
The attorney, John Tiedt, states, "I anticipate more legal (illegal) maneuvering by Heidi Diaz to evade the judgment. We will be prepared and I will be relentless."

I want to congratulate the people who have worked very hard over a long period of time to make this come about.

Note that the Kimkins Web site will live on, and as far as I know the unhealthy diet I described in my review remains unchanged. Ms. Diaz has also started at least one other diet site, called "Meal Perfect".

Thanks for “fighting the good fight.” Fraud in any form is bad, but when you prey on people who are often going to be suffering from low self-esteem, that’s just on another level.

I read the website after reading this article. The sample menu on the website right now is pretty standard.
What I believe is that when you start a diet, you need to do your research. There is too much info around to go blindly and follow just one advise without questioning anything. And most importantly, you need to listen to your body, if yhe diet you are doing is giving you pain, dizzines, etc., STOP and consult a doctor.
I think the sin here is that we want to believe that losing tons of weight in three hours is not going to do any harm.
I know I have been there.

The “sin” here is not in buying into the fallacy of an unrealistic diet. That happens every day to all sorts of people. It may take any individual a number of attempts to find the right path on their healthiness journey. That does not give anyone the right to lie to them in order to get their money. The reason why I sought legal counsel against Heidi Diaz was because she lied and committed consumer fraud against me and thousands of other women like me.

The legal system prevailed – and the court of public opinion is irrelevant.

I read the court ruling and then saw an ad for KimKins on Facebook. They have a Fan Page but nowhere on it is the disclaimer ordered by the judge….
